Urgent: Department of Fish & Game Amendment to Existing Filing Fee Regulations

Attached is a Department of Fish and Game notice of amendment to the existing CEQA filing fee regulations, initial statement of reasons and proposed regulation language changes.

The public meeting for comments is February 2, 2009 10:00 a.m. – Noon

APA California will be opposing these amendments and encourages you to oppose them as well. This is beyond what DFG proposed last year. In the amendments, DFG, not the lead agency, wuold make the “no effect” determination and just about any project would be ineligible for a “no effect” determination. APA is concerned there is still no relationship between the fee and any work done by DFG or the public resources impacted by the project and the proposed regulation once again improperly shifts environmental effect determinations from a lead agency to the DFG.
