As you know, AB 1616, regarding cottage food regulation was enacted last year, and took effect on January 1, 2013. During the legislative process, APA California raised a number of questions and concerns regarding the bill. The bill’s author agreed to submit certain questions to the Office of Legislative Counsel to seek clarification of certain provisions of AB1616 that APA California thought to be less than clear.
Below, please find both the questions submitted to the Office of Legislative Counsel, as well as the responses that were provided. We hope this information is of use to you as to work to address cottage food issues in general, and the new requirements under AB 1616, specifically.
In light of the interpretations offered by the Office of Legislative Counsel, APA California hopes to work with AB 1616’s author on legislation that will clear up some of the outstanding issues.
